Terms of Service
These Terms of Service ("Terms") govern your access to and use of the EasyStagecraft Suite — including EasyOrchestra, EasyInventory, EasyScheduler, EasyRisk, the ESC Course platform, and our websites and related services (together, the "Services"). The Services are operated by Gosling Productions (ABN 50 767 719 891), a business based in Melbourne, Victoria, Australia ("EasyStagecraft", "we", "us", "our").
By creating an account, subscribing, or otherwise using the Services, you agree to these Terms. If you are using the Services on behalf of a school or organisation, you confirm you have authority to bind that organisation. Please also read our Privacy Policy, which forms part of these Terms.

1The Services
EasyStagecraft is a family of browser-based applications for planning and running theatre, music and school productions. The Suite currently includes:
- EasyOrchestra — drag-and-drop, scale-correct stage and orchestra layout planning.
- EasyInventory — set, props and costume asset management with in-app photo capture.
- EasyScheduler — cloud production schedules, crew-call grids and budgets (in build).
- EasyRisk — theatre-specific risk-assessment and OHS documentation tooling (in build).
- ESC Course — curriculum-aligned theatre professional-development content for educators.
Some tools or features are offered free to trial for a limited time without payment. Saving, exporting, printing and cloud sync generally require an active subscription. We may add, change, or discontinue features over time; we'll give reasonable notice of any material change that adversely affects a paid feature you rely on.
2Accounts & eligibility
- You are responsible for keeping your sign-in credentials secure and for activity that occurs under your account.
- You must provide accurate account information (an email address) and keep it current.
- The Services are intended for use by teachers, production staff, crew and adult creators. They are not designed for unsupervised use by children; where students use the Suite, a responsible adult at the school must supervise that use.
- You may invite team members to your account; you remain responsible for your team's use of the Services under your account.
3Subscriptions, billing & refunds
Paid plans are billed through Stripe. By subscribing, you authorise Stripe to charge your nominated payment method for the applicable fees. We do not store your card details — Stripe processes all payments.
- Billing cycle. Subscriptions renew automatically each billing period (monthly or annual, as selected) until cancelled. Prices are in Australian dollars (AUD) unless stated otherwise; GST may apply.
- Cancel anytime. You can cancel your subscription at any time through the Stripe Customer Portal linked from your account page. Cancellation stops future renewals; you retain access until the end of the current paid period.
- Refunds. We offer a 14-day refund, no questions asked — email [email protected] with your order email and we'll process it the same business day. Beyond this, fees are generally non-refundable except where required by the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right under the ACL that cannot lawfully be excluded.
- Education / school billing. Education tiers and School Curriculum Licences may be purchased by purchase order / invoice (Stripe Invoicing, typically Net 30). Education-priced tiers are for bona fide educational use by the purchasing school or educator.
- Price changes. We may change subscription prices on reasonable notice. Changes take effect at your next renewal; if you don't accept a change, you may cancel before it applies.
- Failed payment. If a renewal payment fails, we may suspend paid features until payment is resolved.
4Acceptable use
When using the Services you agree not to:
- Use the Services for any unlawful purpose, or in breach of any applicable law or regulation;
- Upload content you don't have the right to use, or that infringes another party's intellectual property or privacy;
- Attempt to gain unauthorised access to the Services, other accounts, or our systems; probe, scan, or test the vulnerability of the Services without our written permission;
- Interfere with or disrupt the Services, or circumvent usage limits, access controls or paywalls;
- Resell, sublicense, or commercially exploit the Services or their content except as expressly permitted;
- Use the Services to store or transmit malicious code, or to harass, abuse, or harm others;
- Misrepresent your affiliation, or use an education tier for non-educational commercial purposes.
5Your data & content
You retain ownership of the content you create or upload in the Services (your stage layouts, inventory items and photos, schedules, risk records, and similar). You grant us the limited licence necessary to host, store, process and display that content solely to provide the Services to you. We will handle your personal information in accordance with our Privacy Policy, and we do not sell your data or use it to train AI/ML models. You are responsible for ensuring you have the right to upload any content and that it complies with these Terms.
6Intellectual property
The Services — including all software, design, layout, text, graphics, logos, the EasyStagecraft and Easy* product names, course materials, templates, and the hazard / SOP / SWMS libraries we provide — are owned by or licensed to Gosling Productions and are protected by intellectual property laws. We grant you a non-exclusive, non-transferable, revocable licence to use the Services and our provided templates for your own production and educational work for the duration of your subscription. You may not copy, redistribute, resell, or create derivative products from our materials except as expressly permitted in writing. Third-party assets used within the Services (for example instrument icons under their own open licences) remain subject to those licences.
7EasyRisk & OHS — important disclaimer
If you use EasyRisk (or any output of the Suite) in a workplace, you acknowledge and agree that:
- You are responsible for your own compliance. The venue, school, production company or other person conducting the business or undertaking (PCBU) remains solely responsible for meeting its work health and safety duties under the applicable WHS / OHS legislation. Those duties cannot be transferred to a software tool.
- You must verify every output. You must review, edit, complete and verify the suitability of any document for your specific workplace — including the completeness of identified hazards, the adequacy of controls, the correct risk scoring, and the current version of any standard referenced — before relying on or acting on it.
- We do not make safety-critical decisions for you. The Suite may suggest standard hazards or controls, but it does not assert that any set is correct or complete for your workplace, and it does not auto-finalise documents — you enter, review and approve the content.
- No "approved" or "guaranteed compliant" claim. We describe EasyRisk as WorkSafe-aligned and based on AS/NZS standards. We do not represent that it makes you "compliant", "WorkSafe approved", or "legally guaranteed", and you must not rely on it as if it did.
To the maximum extent permitted by law, you assume responsibility for your use of EasyRisk outputs in any workplace, and you agree we are not liable for incidents, injuries, losses, penalties or claims arising from that use.
8Warranties & disclaimers
The Services are provided on an "as is" and "as available" basis. We work to keep the Services reliable and accurate, but to the maximum extent permitted by law, and except for guarantees that cannot be excluded under the Australian Consumer Law, we do not warrant that the Services will be uninterrupted, error-free, secure, or fit for any particular purpose, or that any content, template, standard reference or output is accurate, current or complete. Any reliance you place on the Services is at your own risk, subject to your non-excludable consumer rights.
9Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to that, and to the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, data, goodwill, or for any loss arising from your use of (or inability to use) the Services or any output of them — including any workplace incident or OHS matter (see §7).
- Where our liability cannot be excluded but can be limited, our total aggregate liability to you for any claim is limited, at our option, to re-supplying the Services or refunding the fees you paid to us for the Services in the 12 months before the claim.
10Suspension & termination
You may stop using the Services and cancel your subscription at any time (see §3). We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Services or other users. On termination, your right to use the Services ends; you may export your data beforehand or within any grace period described in our Privacy Policy. Sections that by their nature should survive termination (including IP, disclaimers, and limitation of liability) will continue to apply.
11Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
12Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. If we make a material change, we will take reasonable steps to notify active account holders (for example by email) before it takes effect. Continued use of the Services after an update means you accept the revised Terms.
